China’s Communist Party Emphasizes Independent and Impartial Judiciary

The Communist Party of China Central Committee has issued new guidelines reinforcing the importance of independent and impartial judicial work across the nation. The directives urge Party committees at all levels to actively support the people’s courts in exercising judicial power in accordance with the law.
The guidelines underscore the critical need for strict adherence to systems designed to record, report, and hold accountable any interference in judicial activities or involvement in specific case handling. This move aims to ensure the integrity of the judicial process.
Furthermore, the document emphasizes the role of impartial judicial practices in achieving high-quality development. This includes improving the legal framework for the business environment to safeguard the socialist market economy and strengthening financial adjudication, particularly in emerging sectors.
To ensure high-level security, the guidelines call for enhanced judicial protection of minors’ rights and interests, upholding the principle of their best interests, and strictly punishing crimes committed against them.
The Party also seeks to bolster international commercial adjudication, particularly by the Supreme People’s Court and in key regions. This involves improving coordination with international commercial mediation and arbitration to promote China as a preferred venue for resolving international commercial disputes. Finally, the guidelines advocate for the advancement of digital courts and the development of a robust judicial big data system.
